1. Introduction

This privacy notice from ROMEO HAMEL, a French micro-entreprise (SIRET 93013688200022), operating Axera (“we”, “us”, or “our”), explains how and why we may collect, store, use, and/or share (“process”) your information when you use our services (“Services”), such as:

  • Visiting our website at https://axerajournal.com, or any other site that links to this policy;
  • Creating an account, connecting MT4/MT5 accounts, and using the Axera web application;
  • Contacting us for support, billing, or product questions.

2. Data collected

When you use our Service, we may collect the following categories of data:

  • Usage data: pages viewed, features used, session activity, browser type, device information, and browsing history on our site.
  • Approximate location (IP-based): when you connect to our website or application, our servers and infrastructure providers receive your IP address. We may derive an approximate location at country or region level from that IP address. We process this data solely to secure the Service (fraud prevention, abuse detection, and access protection), troubleshoot technical issues, comply with legal obligations where applicable, and understand aggregate usage by broad geographic area. We do not use IP-based location to track your precise physical movements or to build individual location profiles.
  • Account data: email address, name or display name, authentication identifiers (including Google OAuth when you choose that sign-in method), subscription status, and account settings.
  • MT4/MT5 connection data: account login, server name, platform (MT4 or MT5), account display name, connection status, equity, balance, currency, and prop-firm flags. Your investor password is transmitted to our subprocessors to establish the connection but is not stored in our database.
  • Trading and journal data: synced deals, open and closed positions, performance statistics, notes you add to positions, and photos you upload to your journal (stored in our file storage).
  • Payment data: billing status, subscription plan, and payment metadata processed by Stripe. We do not store full card numbers on our servers.
  • Support communications: messages you send by email, WhatsApp, or other support channels, and related account context.
  • Technical logs: security, error, sync, and performance logs needed to operate and protect the Service.
  • Preference data: UI and filter preferences stored in cookies or local storage to remember your choices between sessions.

3. Legal basis for processing

We process your personal data only when based on one of the following legal grounds:

  • Your prior consent (e.g., optional marketing communications);
  • Contractual necessity (e.g., account creation, MT sync, subscription delivery, and support);
  • Our legitimate interest in improving, securing, and operating the Service, balanced against your rights;
  • Compliance with legal obligations.

4. How we use your data

We process your personal data for the following purposes, in line with our Terms of Service:

  • Provide and manage the Service: creating and managing accounts, syncing MT4/MT5 trades, displaying dashboards, journal entries, and portfolio views, and ensuring secure access.
  • Improve user experience: analyzing product usage to optimize features and performance.
  • Provide support: responding to your requests by email, WhatsApp, or other channels.
  • Ensure security: preventing fraud, unauthorized access, or abuse.
  • Communicate: sending service updates, billing notices, and product information where permitted.
  • Process payments: managing subscriptions and invoices through Stripe.

We do not use your data for automated decision-making that produces legal or similarly significant effects on you.

5. Your rights

You have the following rights concerning your personal data:

  • Right of access: request access to your data and information about how it is processed.
  • Right to rectification: request correction or completion of inaccurate or incomplete data.
  • Right to erasure: request deletion of your data in certain cases.
  • Right to restrict processing: request temporary or permanent restriction of processing.
  • Right to data portability: receive your data in a readable format and transmit it to another provider where applicable.
  • Right to object: object to certain processing, especially for marketing purposes.
  • Withdrawal of consent: withdraw consent at any time when processing is based on it.

6. Update or delete your information

7. Data retention

We retain your data only as long as necessary for the purposes described above. Account and trading data are generally kept while your account is active and for a limited period afterward where required for legal, billing, or security purposes. Support exchanges may be retained for up to 6 months after account deletion unless a longer period is required by law.

8. Security

We implement appropriate technical and organizational measures to protect your personal data against unauthorized access, loss, or alteration. However, no internet transmission or storage system can be guaranteed to be 100% secure.

9. Hosting and data storage

Your data is hosted through third-party infrastructure providers that support our Service, including:

  • Convex — database, authentication integration, file storage, and real-time backend services;
  • Vercel Inc. — frontend hosting (340 S Lemon Ave #4133, Walnut, CA 91789, United States);
  • Stripe — payment processing;
  • MetaApi — MT4/MT5 account provisioning and trade sync;
  • Google — OAuth sign-in when you choose that option.

These providers offer industry-standard security measures and process data under their own privacy policies and data processing terms.

10. International data transfers

ROMEO HAMEL is established in France. Some of our service providers process personal data outside the European Economic Area (EEA), in particular in the United States. When personal data is transferred to countries that have not been recognized by the European Commission as providing an adequate level of data protection, we implement appropriate safeguards as required by GDPR Chapter V.

The main cross-border transfers involved in operating Axera are:

  • Vercel Inc. (United States) — hosts our website and may process connection logs and related technical data. Transfers to Vercel are protected by the European Commission's Standard Contractual Clauses (SCCs), incorporated into Vercel's Data Processing Addendum.
  • Convex (United States) — stores account-related data, trading data, journal photos, and backend logs required to run the Service. Transfers to Convex are protected by SCCs under Convex's data processing terms.
  • Stripe (United States / European entities) — processes payment and billing data. Stripe may transfer data to the United States and other countries where it or its affiliates operate. Stripe relies on SCCs, and where applicable Stripe Payments Europe Ltd. acts as a European payment processor.
  • MetaApi — processes MT connection credentials and trading data required to sync your accounts. MetaApi may process data outside the EEA under its own data protection terms and applicable transfer mechanisms.

11. Disclosure

We may disclose your personal information if required by law, to protect our rights, or if you violate our Terms of Service. We do not sell your personal data.

We may share limited data with service providers who help us operate the Service (hosting, payment processing, trade sync, email delivery) under contractual obligations to protect your data.

12. Cookies and similar technologies

We use cookies, local storage, and similar technologies to maintain sessions, remember preferences (such as dashboard filters and UI settings), and operate the Service securely. Some cookies are strictly necessary for the Service to function (for example authentication and security). We do not use advertising cookies.

You may adjust your browser settings to refuse cookies. Refusing essential cookies may prevent you from signing in or using core features of Axera.

13. Your rights under GDPR

If you are in the European Economic Area or United Kingdom, you may exercise the rights listed in section 5. We have one month to respond to a valid request. Contact us at contact.axerajournal@gmail.com. You also have the right to lodge a complaint with your local supervisory authority. In France, this is the CNIL.

14. Your rights under U.S. privacy laws

If you are a resident of California or another U.S. state with specific data protection laws, you may have the following rights:

  • To know what personal data we collect, use, or disclose;
  • To request access to or deletion of your data;
  • To opt out of the sale or sharing of your personal information (we do not sell your data);
  • To appoint an authorized agent to exercise these rights on your behalf.

15. Children's information

Axera is not intended for users under 18. If you believe a child has provided personal information through our Service, contact us immediately and we will take steps to delete such data.
